Agreement for Jacobson’s Ladder Life Enrichment Solution Services
In consideration of the mutual covenants, and upon the conditions set forth herein, Client requests and Consultant (Jacobson’s Ladder Life Enrichment Solution Specialist) agrees to provide consulting services as follows:

Description of Services
The services to be provided by the Consultant are designed jointly between Consultant and Client and are based on the Client’s expressed interests, goals, and objectives.  Consultant employs discussion, questions, and suggestions to assist Client in reaching Client’s own objectives.  
Consulting is designed to address issues the Client would like to consider which could include life balance, spiritual growth, lifestyle management, relationship enhancement, career development, achieving short-term or long-term goals, ministry objectives, leadership, and organizational development.  Client acknowledges that deciding how to handle these issues, incorporate consulting into those areas, and implementing choice is exclusively the Client’s responsibility.  
Consulting is for people who are basically well-adjusted, emotionally healthy, effectively functioning, and wanting to make changes in their lives or more intentionally focus on a challenge or objective.  Consulting is collaborative and is most effective when both parties are candid, open, honest, and straightforward in their communication.
 
Consulting depends largely on the Client’s willingness to define and try new approaches and take an active part in the process.  The Client is expected to evaluate his or her own progress and be solely responsible for the documentation and record keeping related to that progress.  If the consulting is not working as the Client wishes, the Client should immediately inform the Consultant so steps can be taken to correct the problem.  Like any human endeavor, consulting can bring about uncertainty that is a normal part of adapting to change.  

Consulting does not promise the Client will take any specific action or attain specific goals and does not offer any guarantee of success.  

Nature of Communication
The Client understands that the consulting communication is not psychotherapy, psychological counseling, or any type of mental health therapy; nor is it a substitute for these services.  During the course of the consulting services, Client and/or Consultant might use the terms "therapy," "patient," or "treatment," and both fully understand that they are referring to the generic definitions of those terms such that: (1) the word "therapy" means "any act, hobby, task, program, etc., that relieves suffering," (2) the word "patient" means "the recipient of any various personal services," and (3) the word "treatment" means "the manner in which something is cared for or dealt with."  In the event the Client feels the need for professional counseling or psychotherapy, it is the responsibility of the Client to seek a licensed professional who can provide these services.  If the Consultant believes that such services will be valuable to the Client, the Consultant will recommend them.  It is the responsibility of the Client, if currently in psychotherapy or otherwise under the care of a mental health professional, to consult with the mental health professional regarding the advisability of working with a consultant and to make such person aware of the decision to proceed with the consulting partnership.  

The Client understands that the consulting communication is not to be used as a substitute for professional advice by legal, medical, financial, business, spiritual or other matters.  The Client understands and acknowledges that all decisions in these areas are exclusively the Client’s and that any decisions and actions regarding them are the sole responsibility of the Client.
 
Waiver
The Client acknowledges and agrees that in the course of the services the Consultant may ask the Client questions that may be personal and challenging.  The Client acknowledges and agrees that the Client is fully responsible for their  physical, mental, and emotional well-being during consulting sessions, and is fully responsible for any actions, choices and decisions made as a result of the consulting.  The Client waives and releases any claims arising or results from the Consultant’s questions, suggestions, advice and from actions, choices and decisions made by the Client.  This waiver does not apply to conduct or actions made by the Client outside the scope of the consulting services.  

Mutual Non-disclosure and Confidentiality
The Consultant and the Client mutually recognize that they may discuss future plans, business affairs, customer lists, financial information, job information, goals, personal information, and other private information.  In order to honor and protect the Client’s privacy, the Consultant will not keep any kind of Client file, notes, written or digital record, or other related correspondence whatsoever.  The only true way to guarantee your confidentiality is if no records of any kind are kept.  This will protect you from any interfering third parties who might want to use information from your private life against you.  At the request of the Client, Consultant might write a letter to assist the Client in seeking other services for the betterment of their health and wellness.  Copies of the those letters will be given directly to the client for safekeeping but the Consultant will not keep any such correspondence on record for the reasons stated above.  In order to provide you with the highest quality of service your Consultant reserves the right to discuss and receive consultation on certain topics anonymously and hypothetically with other consultants for said purpose.  

Scheduled Appointments
Consulting is scheduled at the mutual convenience of the Consultant and the Client.  The day and time for the next face-to-face appointment, telephone call, videoconferencing, or live internet chat will be scheduled and/or verified at the close of each consulting session.  Appointments are not available by email, text, or writing due to the security risks.  All sessions begin and end at the scheduled times.  If the Client is late for an appointment, the Consultant will make a best effort to be flexible and adaptable so that the time allotted is granted.  If under those circumstances the appointment time is cut short, the Client will still be required to pay the full agreed-upon fee unless arrangements were otherwise made beforehand.  The Consultant will make an effort to call the Client who is running late for an in-person appointment and may begin and/or complete the appointment by telephone as appropriate.  

Cancellations
Cancellations must be made 24 hours in advance.  If the Client misses or cancels a scheduled appointment without providing at least 24 hours notice (or an adequate explanation), the Client is liable for the entire session fee and no refund or credit for cancellations made less than 24 hours prior to a scheduled session will be made.  Jacobson’s Ladder requests that you provide a credit card number to keep on file in the event the Client does not cancel their appointment within the aforementioned timeframe.  The consultant will make reasonable efforts to reschedule sessions that are canceled in a timely manner.

Termination of Services
Although consulting is a comprehensive process, the Client may terminate at any point.  Consulting services are billed at the time of service (or monthly for priority packages) and termination of consulting services by the Client is not subject to a refund of outstanding sessions.  

Payment Procedure
Jacobson’s Ladder is paid (cash, check, in-person credit card, credit card via the internet, or other payment services) either at the time of service or in advance.  The first consulting session will begin after the Client agrees to this document and payment is received.  There will be a $20.00 returned check fee charged to the Client in the event that payment cannot be processed.  

Consulting Fees
The Client agrees to pay Jacobson’s Ladder a fee of $1.00 per minute for the selected time periods of 30 minutes ($30), 60 minutes ($60), 90 minutes ($90), or 120 minutes ($120).  These fees are fixed for all regular Life Enrichment consulting sessions regardless of the forum where the session takes place (in-person, telephone, videoconferencing, or live internet chat).  This agreement between Jacobson’s Ladder (Consultant) and Client will begin on the day the first payment is received and will continue indefinitely unless either party chooses to terminate the Consultant/Client contract.
 
Nature of Agreement
This agreement shall, in all respects, be applicable to consulting service agreements executed and to be performed both within Virginia and other States/Countries (if done via telephone, videoconferencing, or live internet chat).  This agreement constitutes the entire understanding and agreement of the parties and no amendment, change, or modification of this agreement shall be valid, unless in writing and signed by all of the parties hereto.

Counterparts and Signatures
This agreement may be executed in counterparts, and each executed counterpart shall have the efficacy and validity of a signed original and with the same effect as if all parties hereto had signed the same document.  All counterparts so executed shall be deemed to be an original, shall be construed together and shall constitute one agreement.  Photographic copies of such executed counterparts may be used in lieu of the original for any purpose.
